I don't know the theory as I don't follow it close enough, but the standard for judging a trial is not the result or the merits of either side's position, it is the process. More specifically, it is whether the process is objectively fair and, at least in our country, whether the process is protective of the ACCUSED's rights (not as much the victim). Three trials raises a red flag about the process regardless of the facts and also raises questions about the ACCUSED's rights . . . al though they may have a different view of that in Italy
If I recall correctly, in the event of a finding of "guilt" in the first trial the 2nd trial is automatic in their process, in which she prevailed. The third trial was an appeal by the prosecution held in absentia. Which is where it's at now.
I'm talking about Rudy Guede, the immigrant drug addict convicted of sexually assaulting and killing Meredith Kercher, who left his handprint in the victim's blood at the scene, and his DNA inside of her.And even though he's the person who actually killed Kercher, Italian authorities reduced his sentence to offer testimony against Knox.
Right, no doubt. They are also claiming that the broken window and other apparent break-in evidence was actually a ruse to cover up what they say really happened. But it appears to me that it's a case of the angry black man syndrome,acting alone. So to speak.
I've read more on this and I am not wholly sure, granted only based on Wikipedia, what the theory is. I understand they think the was a staged break in and it seems no one thinks there was a break in. Guede appears to be a pretty clear case he whacked the victim what with the stupid break in story he concocted and the blood. I'm not sure how and where Knox and this other cat enter into this equation. The Italians have a confession it sounds like though.It also appears the Italian judicial system is a big CF of a system too while we are at it in terms of redundancy but being tried several times there doesn't mean or have the same implications in terms of jeopardy.
