Unfortunately, self-interested gerrymandering, party politics and more has twisted federal and state governments so badly that both are now largely controlled by extremists ON BOTH SIDES.
The best example of the profoundly negative impact this has on the country is the OPENLY extra-constitutional Texas abortion case, now allowed to stay in place by the extreme conservative tilt in the SCOTUS.
The NEGATIVE impact is obvious in two news articles from this weekend
The FIRST is the destruction of the 3rd wing of the of the "checks and balances" system in the Constitution. . This is CONSERVATIVE (Reaganite) Justice Roberts JOINING the "liberal" contingent in the Court:
In a strongly worded opinion joined by the high court’s three liberal justices, Roberts wrote that the "clear purpose and actual effect" of the Texas law was "to nullify this Court’s rulings." That, he said, undermines the Constitution and the fundamental role of the Supreme Court and the court system as a whole.
(Sounds weirdly familiar, right?)
It is a basic principle, he wrote, "that the Constitution is the 'fundamental and paramount law of the nation,' and 't is emphatically the province and duty of the judicial department to say what the law is.'" He cited as proof the landmark 1803 Marbury v. Madison case, which established the principle of judicial review, allowing the court to nullify laws that violate the Constitution.
“If the legislatures of the several states may, at will, annul the judgments of the courts of the United States, and destroy the rights acquired under those judgments, the Constitution itself becomes a solemn mockery,” he said, quoting the 1809 U.S. v. Peters case, which found that state legislatures can't overrule federal courts. “The nature of the federal right infringed does not matter; it is the role of the Supreme Court in our constitutional system that is at stake.”
The SECOND example ILLUSTRATES exactly what Roberts means when he says "[f]f the legislatures of the several states may, at will, annul the judgments of the courts of the United States, and destroy the rights acquired under those judgments, the Constitution itself becomes a solemn mockery' BY TAKING A LOOK AT GUNS.
This is Governor Newsome of California:
""I am outraged by yesterday's US Supreme Court decision allowing Texas's ban on most abortion services to remain in place, and largely endorsing Texas's scheme to insulate its law from the fundamental protections of Roe v. Wade," Newsom said in a statement.
"But if states can now shield their laws from review by the federal courts that compare assault weapons to Swiss Army knives, then California will use that authority to protect people's lives, where Texas used it to put women in harm's way," the statement continued."
RECALL the argument that LAWSUITS might one day make its cost prohibitive to keep an AR in your home. The Texas case (CREATED BY ABORTION EXTREMISTS and now allowed to continue by a MANUFACTURED COURT) may expand the red state v blue state divide even further by having blue states create a so-called "private" cause of action against gun sellers or even OWNERS
