The strongest OBSTRUCTION case against Trump is the testimony of Don McGahn. Per the Mueller Report, Trump TWICE tried to get McGahn to replace Mueller and then asked himto change the story
Trump blocked McGahn from appearing before Congress today and even issued a tweet suggesting that he didn't want to block McGahn but the lawyers did for future Presidents.
Presumably, the POTUS and his lawyers would not tell a subordinate to break the law by ignoring a subpoena UNLESS there was really strong legal grounds to do so, right? Well, this is a summary of the WH's position:
"The White House is relying on a brand new memo from the Office of Legal Counsel claiming that, as an absolute matter of separation of powers and executive branch autonomy, Congress cannot force the President's senior advisers to testify.
Notably, the memo cites not a single court decision to support this novel proposition. The memo does begrudgingly note in passing that the only court opinion on the matter, a 2008 decision relating to testimony from former White House Counsel Harriet Miers, actually reaches the opposite conclusion: Senior advisers to the President are not immune from compelled congressional testimony.
Of course, there is also extensive precedent against the White House's position. Senior advisers to presidents of both parties have testified in Congress routinely -- and over many decades. The White House's new position would effectively put an end to that longstanding and not particularly controversial practice, or at least give the executive branch a hook on which to selectively prevent some advisers from testifying.
So, the POTUS instructs McGahn to break the law based on a NEW memo written by Barr's Department of Justice . . . not backed up by the law, actually contradicted by the law.
Other than because Trump is afraid of McGahn's testimony, why else would they break the law on such shaky legal grounds?
Are we witnessing further obstruction to cover up prior obstruction?
