Drunk driving is a tough one. I can see the reasoning for tough penalties, but I also see reason tough penalties would be counterproductive. The argument someone can make rational decision to drive when completely hammered is complete BS. We make the penalties so harsh because we want to deter, but very often the person who gets behind the wheel drunk went out with the intention of staying sober. Ultimately our DUI laws are an imperfect solution for an imperfect world.We also have, as a society, very differing and often arbitrary opinions and laws on what being drunk means and what actions you are responsible for under the influence. For example, if you are drunk and decide to drive, you are considered to be responsible for the decision to drive even though you are drunk. OTOH, if you are a college girl who gets drunk and voluntarily has sex and later regret the decision, you are a victim of rape and not responsible for the decision you made under the influence. We are not consistent in our assignation of responsibility under intoxication. And aside from the law there are many things we write off as "drunken stupidity".
Cops pull you over for failure to maintain your lane, weaving, failure to stop or a host of other traffic violations. After which the cop may be able to establish probable cause for DUI investigation. The issue of driving under the influence arises after the stop.
It is a disgraceful display of the American justice system. The dude was THREE TIMES the legal limit, wrecked his car, and killed his friend and teammate. All he gets is 180 days? What a joke.
But if that was me, you, or another Joe Shmoe, they would have thrown us underneath the jail.It's a complete joke.
I hear you guys, but Browns mom has takin Brent under her wing, and the dude has to live with that on his conscience the rest of his life.
I don't think that should matter. Brown's mother forgave him but he's already committed a crime that killed somebody.Any other person that isn't rich, strong, doesn't run fast, can't throw a ball, or can't shoot hoops would be living with guilt in prison for most of their lives.
Well, I don't know about him being rich, he ain't Tony Romo or Dez. The Cowgirls released him after all this came down, and while out on bond, he has been working in a Dallas warehouse packing boxes everyday.
A lot of times prosecutors can freeze your assets until trial is over.
In a DUi case? Never heard of such a thing.
If Whitley thinks that we as a country treat these things trivially then perhaps he should appeal to his own employer to broadcast these trials nationally, just as they did the playoff game Maybe the basic notion of greater exposure often provokes greater response has never occurred to him or perhaps that just hits too close to home.
