JBears's favorite case, Ahmad Arbery, offers two really clear examples of systemic racism, meaning structural features in society that result in uneven application of justice, as one example.

The Slave Defense

With trial approaching the prosecution is asking the Court prevent certain arguments by the defense. The defendants want to have someone testify that a since-repealed "civilian arrest" law would have allowed them to LEGALLY kill Arbery.

Which law, you say?

"The citizen arrest law, repealed in May, was approved in 1863 as a means to round up escaped slaves. The law's critics argue it was later used to justify the lynching of Black Americans, and Georgia Gov. Brian Kemp, a Republican, called it "ripe for abuse." Its repeal in May was a reaction to Arbery's death. "

Is there a comparable law for WHITE people? :-)

The Good Ol Boy Testimony

The defense wants a prior prosecutor, George Barnhill, to testify that he would not have charged the three defendants.

In case you dont know about George Barnhill:

"In an open letter to the Georgia State Bar Thursday, more than 300 Georgia attorneys joined with several civil rights groups demanding Brunswick District Attorney Jackie Johnson and Waycross District Attorney George Barnhill step down from their positions."

"“There were a lot of issues in both the actions – in both Barnhill and Jackie Johnson – that we as attorneys needed to speak up and say something about it. And not only that but the fact that George Barnhill wrote this letter prematurely exonerating the McMichael’s and in that letter he offered factually incorrect, and legally unsound information,” said Richardson. “What I wanted to say with 313 other attorneys across Georgia was enough was enough.”"

TO SIMPLIFY IT FOR YOU

One of the killers was an investigator for the first prosecutor, Johnson, so she passed it off to her friend, Barnhill, whose son works for Johnson and he tried to completely whitewash the case

now the defense wants him to testify lol

SO . . the defendants say they can legally kill Arbery because of an 1863 slave roundup law thats been used to justify lynchings AND the entire legal system in the local area initially CONSPIRED to help the WHITE defendants until the feds stepped in and now they defense wants one of the conspirators to testify.
